Warranty
Every item you buy from us has a warranty, if stated so on the warranty card or invoice. This is valid for one year from the date of purchase. The warranty covers all manufacturing defects as well as defects in the product's material.
Damage to the item due to improper use and normal wear and tear during regular use is excluded from the warranty.
Because we want you to be truly satisfied with our products, we are ready to listen to any problem you may have with any of our items at any time. You can send us an e-mail or call us and we will make an agreement.
Guarantee for conformity of goods
The seller must deliver the goods to the buyer in accordance with the contract and is responsible for the conformity of his performance.
The goods are in conformity with the sales contract in particular when this is appropriate:
1. corresponds to the description, type, quantity and quality and has the functionality, compatibility, interoperability and other properties required in the sales contract;
2. is suitable for the specific purpose for which the buyer requires it and which the buyer has informed the seller of at least at the time of conclusion of the sales contract and the seller has agreed to;
3. is supplied with all accessories and instructions, including installation instructions, as specified in the sales contract, and
4. is up-to-date as specified in the sales contract.
In addition to meeting the requirements of the above paragraph, the goods must also:
1. be suitable for the purposes for which goods of the same type are normally used, taking into account, where appropriate, other regulations, technical standards or, in the absence of such technical standards, industry codes of practice applicable to the sector in question;
2. be of such quality and correspond to the description of the sample or model made available to the buyer by the seller before the conclusion of the sales contract, where appropriate;
3. be supplied with such accessories, including packaging, installation instructions or other instructions, as the buyer can reasonably expect to receive, where appropriate, and
4. be of such quantity and have such characteristics and other properties, including those relating to durability, functionality, compatibility and safety, as are usual for goods of the same type and which the buyer can reasonably expect, having regard to the nature of the goods and taking into account any public statement made in advertising or labelling by or on behalf of the seller or other persons in the preceding links of the contractual chain, including the manufacturer, unless the seller proves that:
- he was not aware of the public statement and could not reasonably be expected to be aware of it,
- the public statement was corrected in the same or comparable way by the time the sales contract was concluded, or
- the public statement could not have influenced the decision to purchase the goods.
The suitability of the goods for normal use shall be assessed in relation to ordinary goods of the same type and taking into account any statements made by the seller or the manufacturer about the characteristics of the goods, in particular through advertising, product presentation or indications on the goods themselves.
The buyer may exercise his rights arising from the conformity of the goods if he notifies the seller of the non-conformity within two months of the date on which the non-conformity was discovered. The buyer must describe the defect in more detail in the notification of the non-conformity and allow the seller to inspect the item.
The seller is not liable for a non-conformity of the goods that becomes apparent after two years have passed since the item was delivered. The defect in the item is deemed to have already existed at the time of delivery if it appears within one year of delivery.
In the event of non-conformity of the goods, the buyer who has notified the seller of the non-conformity of the goods is entitled, under the conditions and in the order set out in this section, to:
1. request the seller to bring the goods into conformity free of charge;
2. request a reduction in the purchase price in proportion to the lack of conformity or withdraw from the sales contract and request a refund of the amount paid.
The buyer may request the seller to bring the goods into conformity free of charge and without significant inconvenience to the buyer within a reasonable period of time from the moment the seller is informed of the lack of conformity, which shall not exceed 30 days, taking into account in particular the nature of the goods and the purpose for which the buyer requires the goods.
The deadline may be extended to the shortest time necessary to complete the repair or replacement, but for a maximum of 15 days. When determining the extended deadline, the nature and complexity of the goods, the nature and seriousness of the lack of conformity and the effort required to complete the repair or replacement shall be taken into account. The seller shall inform the buyer of the number of days for the extension of the deadline and the reasons for its extension before the expiry of the deadline referred to in the previous paragraph.
In order to restore conformity of the goods, the buyer may choose between repair of the goods and replacement of the goods with new, faultless goods, unless:
- the fulfilment of the selected warranty claim is impossible or
- the fulfilment of the selected warranty claim represents disproportionate costs for the seller compared to another warranty claim, taking into account all the circumstances.
The buyer may request a proportional reduction of the purchase price or withdraw from the sales contract in any of the following cases:
- the seller has not repaired or replaced the goods or, where applicable, has not completed the repair or replacement of the goods in accordance with this Act or has rejected the buyer's warranty claim for the establishment of conformity of the goods in accordance with the sixth paragraph of the previous article;
- the lack of conformity exists even though the seller has attempted to establish conformity;
- the nature of the lack of conformity is so serious as to justify an immediate proportional reduction of the purchase price or withdrawal from the sales contract, or
- the seller has stated or it is obvious from the circumstances that the seller will not establish conformity of the goods within a reasonable time or without significant inconvenience to the buyer.
Notwithstanding the previous paragraph, the buyer may withdraw from the sales contract and request a refund of the amount paid if the lack of conformity occurs less than 30 days after delivery of the goods.
In any case, the buyer also has the right to demand compensation from the seller for damages, in particular reimbursement of the costs of materials, spare parts, labor, transfer and transportation of products incurred due to the fulfillment of obligations.
The buyer's rights expire after two years from the date on which he notified the seller of the non-conformity.
The buyer reports the complaint to the e-mail address: info@gajo.si, and must attach a copy of the original invoice or other proof (e.g. bank statement) to the returned goods, which shows the date and time of purchase. The seller will confirm receipt of the complaint within 5 days of the buyer's written notification and inform him how the complaint handling procedure will proceed. If the existence of a defect in the goods is not disputed, the seller must comply with the buyer's request as soon as possible, but no later than within eight days. The seller must respond to the buyer in writing no later than eight days after receipt of the request, if the existence of a defect in the goods is disputed.
In the event of a replacement of goods that is not the result of a complaint and that is approved by the seller, the buyer shall cover all costs associated with this, i.e. the costs of returning the goods, the costs of re-sending the goods and any difference in price.
Right to withdraw from the purchase, return of goods
The buyer has the right to notify the company within 14 days that he withdraws from the contract, without having to state the reason for his decision. He shall notify this to the e-mail address: info@gajo.si. In this case, only the costs of returning the goods shall be borne by the buyer. ((Article 134 of the ZVP) In contracts concluded at a distance or outside business premises, the consumer has the right to notify the company within 14 days that he withdraws from the contract, without having to state the reason for his decision.)
The withdrawal period begins to run on the day on which the buyer acquires actual possession of the goods.
The buyer must notify the provider of the withdrawal from the contract on the form (you can get the form here) or with an unambiguous statement from which it is clear that he is withdrawing from the contract. The withdrawal statement must be sent within the deadline set for withdrawal from the contract.
In the event of withdrawal from the contract, the provider will immediately or at the latest within 14 days after receiving the notification of withdrawal from the contract, return all payments received to the buyer.
We may withhold the refund until we receive the returned goods or until we receive proof that you have sent the goods back.
In accordance with Article 135 of the ZVPot-1, withdrawal from the contract is not possible if products, food supplements and other special products have been ordered. This does not apply to the delivery of incorrect products.
If the buyer has already received the goods and withdraws from the order, he must send the goods undamaged and in an undiminished quantity to the provider within 14 days after the message about withdrawal from the order was sent. The buyer is deemed to have returned the goods on time if they are sent before the 14-day return period has expired. Although this is not mandatory, we will be happy to provide a reason for the return.
The return of the goods must also be accompanied by a copy of the original invoice or other proof (e.g. bank statement) showing the date and time of purchase.
The buyer returns the goods by:
sending the postal item to the provider's address below, with the buyer covering the costs of returning the goods.
